유엔해양법협약 제194조(해양환경 오염의 방지, 경감 및 통제를 위한 조치)

1. 각국은 개별적으로 또는 적절한 경우 공동으로, 자국이 가지고 있는 실제적인 최선의 수단을 사용하여 또한 자국의 능력에 따라 모든 오염원으로부터 해양환경 오염을 방지, 경감 및 통제하는 데 필요한 이 협약과 부합하는 모든 조치를 취하고, 또한 이와 관련한 자국의 정책을 조화시키도록 노력한다.
2. 각국은 자국의 관할권이나 통제하의 활동이 다른 국가와 자국의 환경에 대하여 오염으로 인한 손해를 주지 않게 수행되도록 보장하고, 또한 자국의 관할권이나 통제하의 사고나 활동으로부터 발생하는 오염이 이 협약에 따라 자국이 주권적 권리를 행사하는 지역 밖으로 확산되지 아니하도록 보장하는 데 필요한 모든 조치를 취한다.
3. 이 부에 따라 취하여진 조치는 해양환경의 모든 오염원을 다룬다. 이러한 조치는 특히 다음의 사항을 가능한 한 가장 극소화시키기 위한 조치를 포함한다.
(a) 육상오염원으로부터, 대기로부터, 대기를 통하여 또는 투기에 의하여 특히 지속성있는 유독·유해하거나 해로운 물질의 배출
(b) 선박으로부터의 오염, 특히 사고방지, 긴급사태의 처리, 해상작업의 안전확보, 고의적 및 비고의적 배출의 방지, 선박의 설계·건조·장비·운용 및 인원배치의 규제를 위한 조치
(c) 해저와 하층토의 천연자원의 탐사나 개발에 사용되는 설비나 장치로부터의 오염, 특히 사고방지, 긴급사태의 처리, 해상작업의 안전확보, 또한 이러한 설비나 장치의 설계·구조·장비·운용 및 인원배치의 규제를 위한 조치
(d) 해양환경에서 운용되는 그 밖의 설비나 장치로부터의 오염. 특히 사고방지, 긴급사태의 처리, 해상작업의 안전확보, 또한 이러한 설비나 장치의 설계·구조·장비·운용 및 인원배치를 규제하기 위한 조치
4. 각국은 해양환경 오염을 방지, 경감 및 통제하기 위한 조치를 취함에 있어서 다른 국가가 이 협약에 따른 권리 행사나 의무 이행상 수행하는 활동을 부당하게 방해하지 아니한다.
5. 이 부에 따라 취하여진 조치는 매우 희귀하거나 손상되기 쉬운 생태계, 고갈되거나 멸종의 위협을 받거나 위험에 처한 생물종 및 그 밖의 해양생물체 서식지의 보호와 보존에 필요한 조치를 포함한다.

1. States shall take, individually or jointly as appropriate, all measures consistent with this Convention that are necessary to prevent, reduce and control pollution of the marine environment from any source, using for this purpose the best practicable means at their disposal and in accordance with their capabilities, and they shall endeavour to harmonize their policies in this connection.

2. States shall take all measures necessary to ensure that activities under their jurisdiction or control are so conducted as not to cause damage by pollution to other States and their environment, and that pollution arising from incidents or activities under their jurisdiction or control does not spread beyond the areas where they exercise sovereign rights in accordance with this Convention.

3. The measures taken pursuant to this Part shall deal with all sources of pollution of the marine environment. These measures shall include, inter alia, those designed to minimize to the fullest possible extent:

(a) the release of toxic, harmful or noxious substances, especially those which are persistent, from land-based sources, from or through the atmosphere or by dumping;

(b) pollution from vessels, in particular measures for preventing accidents and dealing with emergencies, ensuring the safety of operations at sea, preventing intentional and unintentional discharges, and regulating the design, construction, equipment, operation and manning of vessels;

(c) pollution from installations and devices used in exploration or exploitation of the natural resources of the seabed and subsoil, in particular measures for preventing accidents and dealing with emergencies, ensuring the safety of operations at sea, and regulating the design, construction, equipment, operation and manning of such installations or devices;

(d) pollution from other installations and devices operating in the marine environment, in particular measures for preventing accidents and dealing with emergencies, ensuring the safety of operations at sea, and regulating the design, construction, equipment, operation and manning of such installations or devices.

4. In taking measures to prevent, reduce or control pollution of the marine environment, States shall refrain from unjustifiable interference with activities carried out by other States in the exercise of their rights and in pursuance of their duties in conformity with this Convention.

5. The measures taken in accordance with this Part shall include those necessary to protect and preserve rare or fragile ecosystems as well as the habitat of depleted, threatened or endangered species and other forms of marine life.
