유엔해양법협약 제38조(통과통항권)

1. 제37조에 언급된 해협내에서, 모든 선박과 항공기는 방해받지 아니하는 통과통항권을 향유한다. 다만, 해협이 해협연안국의 섬과 본토에 의하여 형성되어 있는 경우, 항행상 및 수로상 특성에서 유사한 편의가 있는 공해 통과항로나 배타적경제수역 통과항로가 그 섬의 바다쪽에 있으면 통과통항을 적용하지 아니한다.
2. 통과통항이라 함은 공해 또는 배타적경제수역의 일부와 공해 또는 배타적 경제수역의 다른 부분간의 해협을 오직 계속적으로 신속히 통과할 목적으로 이 부에 따라 항행과 상공비행의 자유를 행사함을 말한다. 다만, 계속적이고 신속한 통과의 요건은 해협연안국의 입국조건에 따라서 그 국가에 들어가거나 그 국가로부터 나오거나 되돌아가는 것을 목적으로 하는 해협통항을 배제하지 아니한다.
3. 해협의 통과통항권의 행사가 아닌 활동은 이 협약의 다른 적용가능한 규정에 따른다.

1. In straits referred to in article 37, all ships and aircraft enjoy the right of transit passage, which shall not be impeded; except that, if the strait is formed by an island of a State bordering the strait and its mainland, transit passage shall not apply if there exists seaward of the island a route through the high seas or through an exclusive economic zone of similar convenience with respect to navigational and hydrographical characteristics.

2. Transit passage means the exercise in accordance with this Part of the freedom of navigation and overflight solely for the purpose of continuous and expeditious transit of the strait between one part of the high seas or an exclusive economic zone and another part of the high seas or an exclusive economic zone. However, the requirement of continuous and expeditious transit does not preclude passage through the strait for the purpose of entering, leaving or returning from a State bordering the strait, subject to the conditions of entry to that State.

3. Any activity which is not an exercise of the right of transit passage through a strait remains subject to the other applicable provisions of this Convention.
